ה״שנדו״, מועדון החשפנות האחרון הפועל כרגע בתל אביב, פנה לאחרונה בבקשה לוועדת התכנון של העירייה, להאריך את האישור החורג שלהם לפעול בחמש שנים נוספות. לפני כשבועיים פרסמה העירייה על גבי קירות בניינים הסמוכים למועדון, שפועל ברחוב שונצינו 1, הודעה פומבית לפי סעיף 149 לחוק התכנון והבנייה, שבמסגרתה הזמינה תושבים להגיש התנגדויות למתן ההיתר.
מדובר בהחלטה תמוהה, לאחר שבספטמבר 2020 פרסמה עיריית תל אביב החלטה שלפיה לא יינתנו היתרים לשימוש חורג לצורך פעילות של מועדוני חשפנות בשטחה ללא דיון מקדים. לפי פרסום בהארץ, היתה זו ועדת המשנה לתכנון ובנייה בעירייה שאישרה את מסמך המדיניות "המקשה על פתיחת מועדוני חשפנות חדשים, שיזדקקו לאישור מיוחד מהוועדה אשר תדון בכל בקשה כזו בנפרד".
לפי החלטת העירייה נסגרו רבים ממועדוני החשפנות בעיר, לאחר פשיטות של המשטרה. בפברואר 2020, למשל, סגרה המשטרה שלושה מועדונים: הבייבידולס, גוגו וגם את מועדון השנדו, שמבקש כעת אישור להמשיך את פעילותו. הפעילות המשטרתית נעשתה בעקבות הנחייה של פרקליט המדינה דאז שי ניצן, שריקודים בעלי אופי מיני (לאפ דאנס) שניתנים במועדוני חשפנות ייחשבו כזנות, שהיא עבירה פלילית.
בהחלטת ועדת המשנה לתכנון ובנייה של תל אביב, כפי שהובאה בהארץ, נכתב: "אין צורך להכביר מילים על המתרחש במועדוני החשפנות ועל הקשר בינם לבין תעשיית הזנות האסורה על פי חוק, אשר שתיהן כוללות החפצה וביזוי של נשים. לפעילות במועדוני חשפנות יש כדי להשפיע באופן שלילי על המרחב העירוני בשל מידת ההטרדה שבו ופוטנציאל הסיכון לשלום הציבור".
בפברואר השנה התקבל פסק דין בבית המשפט המחוזי בתל אביב בעקבות עתירה שהגישה בעלת מועדון חשפנות "פלאזה" שפעל ברחוב טברסקי בעיר, לקבל רישיון לעסק. בעלת העסק הזכירה בעתירתה את מועדון השנדו, "הפועל בתנאים ובמגבלות שהעותרת מוכנה אף להחמיר בהם", וציינה כי היא מופלית לרעה לעומתו וכי "אין מקום לאיפה ואיפה". העתירה נדחתה.
בדף הפייסבוק של השנדו נכתב כי "במועדון שנדו היכל ארוטי מיוחד, אשר הפך לתיאטרון המציג את היפות מבנות המין הנשי בשלל צבעים ומיתוסים… נערות הכי נועזות יפתו אתכם במועדון חשפנות שנדו! מדי ערב אנו נשמח לארח אתכם בתוך מועדון הבורדו שלנו. התרווחו בכורסאות העור , תנו לערפל הענוג והוורדרד לעטוף אתכם ולסחרר את החושים שלכם ותיסחפו אל מעבר לכל אשר עולה בדמיונכם. תתבוננו, תהיו קשובים לצלילים, למראות, לתשוקה ודעו כי לא ידעתם עוד דבר על עצמכם. מועדון 'שנדו' מזמין אותכם להעביר את לילה באווירה אחרת: אווירה של טעם וטירוף חושים. אותה האווירה שבה כל החלומות הארוטיים מתגשמים. שואו ללא הפסקה".
בחודש פברואר עלה פוסט בעמוד הפייסבוק של המועדון שקורא לנשים להצטרף למקום: "לימודי ריקוד וכוריאוגרפיה על חשבון המועדון, עבודה בסביבה בטוחה ובאווירה כייפית. הרווחים כ1000 בממוצע במשמרת של 6 שעות. מינימום 4 משמרות בשבוע".

״בניגוד למיתוסים הרווחים, לפיהם מדובר בבחירה מתוך העצמה נשית נטולת ניצול – בפועל אל מועדוני החשפנות מגיעות ברוב המכריע של המקרים צעירות בעלות עבר קשה, ללא כל רשת של תמיכה", אומרת אור אבו, מנהלת המטה למאבק בסחר בנשים ובזנות. "מועדוני חשפנות מציירים את עצמם כמקומות בילוי לגיטימיים ונורמטיביים, אבל מתקיימים בעיקרם על רווחים מ'חדרים אחוריים' והעניין של ה'לקוחות' אינו בריקוד המתרחש על הבמה, אלא באפשרות לרכוש שירותי מין מאחורי הקלעים. אנו קוראות לחברי וועדת המשנה לתכנון ובנייה של עיריית תל אביב לממש את התחייבותם לתושבי העיר ולדחות את הבקשה להיתר לשימוש חורג שהגיש מועדון השנדו. בכך תהווה עיריית תל אביב דוגמה לכלל הרשויות המקומיות בישראל בהיותה העיר המובילה בהגנה על כבודן וביטחונן של נשים בתחומה״.
"לפני שטוענים טענות, צריך שיהיו הוכחות", אמרה הבוקר מנהלת השנדו בשיחה עם המקום הכי חם. "לא ראיתי אף אחת מהמטה אצלנו. אני מזמינה אותם לבקר בשטח. להמציא דברים זה קל. אנחנו לא קשורים לזנות או לעבירות של סחר בנשים בשום צורה וממלאים את הדרישות של הרשויות. מה שאנחנו עושים הוא חוקי במדינה".
מעיריית תל אביב-יפו נמסר בתגובה: כנגד העסק המדובר הוגש כתב אישום בגין ניהול עסק ללא רישיון. חשוב להבין כי מדיניות הועדה המקומית הינה שלא לאשר שימוש של מועדוני חשפנות במסגרת בקשות לשימוש חורג. אולם ככל שמוגשת בקשה לשימוש חורג היא נבחנת ונדונה באופן פרטני.
