בשבוע שעבר סיירה שרת הפנים איילת שקד בדרום תל אביב ופגשה שם נציגים של העירייה ושל התושבים. בדיווח שיצא לאחר הפגישה נאמר כי השרה "הציגה יוזמה להקמת בתי ספר נפרדים לילדי מבקשי מקלט ועובדים זרים בשטח העיר". שקד הדגישה שם "את הצורך לבחון הקמת בתי ספר במודל בינלאומי לילדי מסתננים וזרים בלתי חוקיים, עם תוכנית לימוד שתכין אותם ליציאה מישראל ברגע שזו תתאפשר".
בשנים האחרונות, בכל פעם שסוגיית גירוש ילדי העובדים הזרים עולה מכיוונו של שר כזה או אחר, עולה הטענה שכנגד כי הילדים הללו לומדים בבתי הספר הישראליים, דוברים את השפה, חוגגים את החגים ובכלל, הם נטמעו בחברה הישראלית ואין להם קשר עם מדינות המוצא של הוריהם. פעמים רבות יצאו חבריהם של ילדי העובדים הזרים להפגנות נגד הכוונה לגרשם.
ה"יוזמה להקמת בתי ספר נפרדים", כפי שהעלתה שקד, צצה בפברואר השנה, כשמפלגת הציונות הדתית שבאופוזיציה חשפה את "תוכנית 100 הימים" לטיפול "בהגירה הבלתי חוקית", שבמסגרתה כתבה: "נקדם החלטה בה ילדי זרים שלהוריהם יש אשרה כלשהי, ילמדו בבתי ספר בינלאומיים בשפה האנגלית ובשפת המקור, על מנת למנוע השתקעות ולהכין אותם לחזרה לארצם".
לאחרונה עברה בקבוצות וואטסאפ של חוקרים ההודעה הבאה: "שאלה שפנו אליי ומפנה לקבוצה זו: אם יש כאן מי שמתעניין/חוקר.ת בתחום חינוך וילדי זרים אז מחפשים שותפים מומחים לדוח למשרד ממשלתי. הדוח אמור לעסוק בחשיבות הקניית כלים לילדי זרים (ילדי עובדים זרים – בהיתר וללא היתר – וילדי מבקשי מקלט) במסגרת מוסדות החינוך, בתחום השפה, התרבות והערכים של מדינת המוצא. לפרטים יש לפנות לד״ר יוסי ברדא [email protected]".
ד"ר ברדא, עורך דין בהשכלתו, הוא עמית מחקר בבית הספר למשפטים במכללה האקדמית צפת ודוקטור למשפטים מאוניברסיטת בר אילן. בשנים האחרונות הוא עוסק במחקר בילדי עובדים זרים. על המחקר שעסק "במעמדם של ילדי הזרים בראי טובת הילד, המשלב ניתוח מתחום המשפט (..) ותיאוריות מתחום הפסיכולוגיה החינוכית", זכה במלגה מקרן זילביגר של עיריית תל אביב-יפו
הקרן, שבהנהלתה יושבים היועץ המשפטי לעירייה, מנכ"ל משרד המשפטים, נציג הוועד המרכזי של לשכת עורכי הדין ונציג מרכז השלטון המקומי בישראל, "מעניקה פרסים ומלגות לסטודנטים מצטיינים שייבחרו בהתאם לתקנון מתוך רשימת סטודנטים מומלצים על ידי הפקולטות למשפטים באוניברסיטאות בארץ".
גם את עבודת התזה והדוקטורט שלו עשה ברדא בסוגיית ילדי העובדים הזרים. התזה שהוגשה ב-2012 הייתה בנושא "התהוות המדיניות ביחס לילדי העובדים הזרים בישראל: בין הקניית מעמד חוקי לבין הרחקה מן הארץ". את הדוקטורט שהוגש השנה, עשה על "מעמדם של ילדי הזרים בראי "טובת הילד": משיח פילוסופי-פוליטי לבחינה פסיכולוגית-חינוכית".
בנוסף, הוא מנחה כנסים בנושא. למשל את הכנס "מסתננים ומבקשי מקלט בישראל", שהתקיים ביולי במרכז בגין בירושלים, בהשתתפות נציג של פורום קהלת.
פנינו לברדא כדי לבדוק מיהו אותו משרד ממשלתי שעבורו הדוח מיועד, והוא טען כי הודעת הוואטסאפ עברה שינוי מאז שיצאה מהמקלדת שלו. "ניסחתי הודעה להשתתף בדוח לכמה חוקרים, כשברור היה בהודעה מי הזמין את הדוח ואיך הוא הולך להיות. בשום מקום לא כתבתי שהדוח הוא למשרד הפנים או למשרד ממשלתי אחר. מי שניסח את זה כך אלו ארגונים שרוצים לטרפד את הדוח מהסיבות שלהם. זה לא נוסח מטעמנו".
לדברי ברדא, את הדוח הזמין "איתן – המרכז למדיניות הגירה ישראלית". את המרכז ייסד ב-2012 עו"ד יונתן יעקובוביץ', ששימש כמנהל שלו עד יולי השנה. לאחר שעזב את התפקיד עבר יעקובוביץ' לכהן כיועץ האישי של שרת הפנים איילת שקד לענייני הגירה.
בפברואר השנה, לאחר שבעיריית לוד סירבו להכניס למערכת החינוך בעיר ילדי עובדים זרים, קרא המרכז למדיניות הגירה ישראלית להקים בתי ספר בינלאומיים. בכתבה שהתפרסמה בעיתון מקומי בלוד, צוטטו "גורמים" במרכז אומרים: “מדיניות זו תואמת את מדיניות הממשלה בעניין השוהים הבלתי חוקיים – להשיבם למדינות המוצא. במקום שילדי הזרים ישתקעו בארץ, צריך להכין אותם ליום שבו הם יוכלו לחזור".
בשיחה שערכנו עם ברדא הוא סיפר כי תפקידו לרכז את הדוח מבחינה אקדמית. "הדוח אמור להיות מורכב מחלקים שונים של אנשי אקדמיה, מחינוך, פסיכולוגיה, עבודה סוציאלית ומשפטים. המטרה היא לבוא ולומר שבמידה ויש ילדים זרים ששוהים בישראל שיצטרכו לחזור למידת המוצא – ואנחנו לא נכנסים בדוח אם הם צריכים לחזור או לא – מן הראוי שבמסגרות החינוך יתנו להם את הכלים הנדרשים מבחינת שפה, תרבות, כלים חינוכיים ומעטפת פסיכולוגית, כדי שלא יצטרכו ביום בהיר אחד לעזוב ואז יהיו להם קשיי התאקלמות במדינת המוצא".
מי אותם אנשי אקדמיה שלוקחים חלק במחקר?
"זה כרגע עוד לא לפרסום. הדוחות שלהם עדיין לא אושרו אקדמית".
איזה מוסד אמור לאשר אותם אקדמית?
"זה לא נעשה דרך מוסד אקדמי. עמותת איתן מרכזת את זה. בסופו של דבר הדוח יעמוד בסטנדרט אקדמי ראוי ומקצועי".
איך אתה מתמודד עם ביקורת שמדובר בדוח אקדמי מטעם, כזה שמטרתו ברורה – לשרת מטרות של עמותה שכוונותיה כלפי קהילת מבקשי המקלט ומהגרי העבודה ברורות?
"יכולה להישמע טענה שזה בא לשרת אינטרסים מסוימים, אבל בסופו של דבר צריך להתמודד עם המציאות והמציאות היא כזו שחלק מילדים זרים שחיים במדינות מארחות ידרשו לחזור".
לצורך הדוח אתם משוחחים עם צוותי חינוך, עם ההורים, עם הילדים?
"זה לא מחקר שדה, אלא מחקר שמבוסס על סקירת ספרות ועל דוחות עמדה של אנשי מקצוע, שכל אחד בא ומציע את משנתו בתחומו. כרגע הדוח הוא ראשוני וממוקד.
"בכתיבה שלי אני מתייחס להיבטים המשפטיים. זה לא תחום הדעת שלי לבוא ולעשות שאלונים להורים ולמורים ולאנשי מקצוע בהקשר הזה. יבואו ויגידו שזה לא מספיק, אדרבא – זו זריקת כיוון. אף אחד לא בדק מה טוב להם, וחשוב להגיד את זה. המטרה בסופו של דבר היא לקדם את טובת הילד הזר".
והמטרה היא הקמת בתי ספר בינלאומיים?
"הקצאת בתי ספר נפרדים היא לא מטרת הדוח. הדוח מדבר על הקניית כלים במסגרת שבה לומד הילד, לא משנה אם היא מעורבת או ייעודית".
משרד החינוך מעורב בזה?
"לא. ברגע שהדוח יהיה מוכן נציג אותו בפני הגורמים הרלוונטיים קובעי המדיניות, כדי שיקחו את זה בחשבון. מי שצריך לקבל או לא לקבל את ההמלצות זו המדינה. משרד החינוך, הפנים, האוצר. כרגע אף משרד לא מעורב".
בניגוד למה שאומר ברדא, מהמרכז למדיניות הגירה נמסר לנו שהדוח כבר מוכן, שהוא נערך לפני חודשים וכי הוא יתפרסם ברגע שהם יראו לנכון לפרסם אותו.
פנינו ליונתן יעקובוביץ', לקבל תגובה לדברים. "השרה חושבת שזה רעיון טוב", הוא אמר, "יש כיוון להתחיל לייצר חשיבה, אבל אני לא מכיר שמשרד הפנים הזמין מחקר ולא הגענו לעסוק בזה בצורה רצינית. אני מקפיד לא להתערב בענייני העמותה ואם העמותה תייצר דוח כזה, אשמח להיעזר בו".

ממשרד החינוך לא נמסרה תגובה.
ממשרד הפנים מסרו: "נושא העובדים הזרים נמצא בטיפול רשות האוכלוסין וההגירה יש לפנות אליהם". לשאלה מה עמדת משרד המשפטים בסוגיית הקמת בתי ספר בינלואמיים, נמסר לנו: "איננו מוסרים חוות דעת משפטיות במסגרת פניות עיתונאיות".
תגובת הארגונים ספריית גן לוינסקי וא.ס.ף – ארגון סיוע לפליטים ולמבקשי מקלט בישראל: "ילדי מבקשי המקלט, ברובם המוחלט, נולדו בישראל ויחיו בה כל חייהם. המשאבים ותשומת הלב צריכים להיות מושקעים בשילובם במערכת החינוך לצד תלמידים ישראלים, ובמענים שיבטיחו שהם יקבלו כלים ויזכו בכישורים כמו כל ילד אחר במדינה. מומחי חינוך, אלו שבאמת ובתמים מעוניינים בטובת הילדים ובטובת מערכת החינוך הישראלית, תמימי דעים ששילוב והכלה של הילדים הוא המפתח להצלחה. פירטנו את הצעדים הנחוצים לכך בתכנית "שילוב וקידום ילדי מבקשי מקלט במערכת החינוך – עקרונות והמלצות".
