11 לקוחות לשעבר של חברת הייעוץ העסקי סקסס הגישו תביעה על סך 550 אלף שקל נגד חברת א.מ טייגר המפעילה את סקסס, נגד בעלת המניות נאית הדר ונגד המייסד, הבעלים והמנהל אלעד הדר. בימים אלו מתגבשת תובענה נוספת נגד הדר וחברת סקסס, הכוללת שישה תובעים לכל הפחות.
חלק מהמרואיינים לכתבה הצטרפו לכתב התביעה, שהוגש בסוף ספטמבר בבית המשפט השלום בתל אביב על ידי עורכי הדין אהב כהן ואור גביש. "במתכונתה המקורית הייתה (התביעה – ג.ה) מיועדת להיות מורכבת מ-11 תביעות נפרדות", נכתב בכתב התביעה. "עם זאת, היות ועסקינן במסכת עובדתית זהה-למדי ואף חופפת במרבית המקרים – הוחלט לאחד את התובענות לכדי תובענה כוללת אחת".
לגבי התובעת הראשונה, שאף התראיינה לכתבה שפרסמנו כאן, נכתב בכתב התביעה כי הדר הגיש נגדה תביעת השתקה על לשון הרע משום שכתבה פוסט בפייסבוק שממליץ לאנשים "לקרוא את החוזה של סקסס לפני שחותמים עליו".
"אין ולא יכול להיות חולק כי הגשתה של תובענת לשון הרע נטולת בסיס משפטי נועדה אך ורק לשים מקלות בגלגלים של מי שמבקשת למצות את זכויותיה המשפטיות", כתבו עורכי הדין.
כתב התביעה מציין כיצד גרמו הדר וצוות משרדו ללקוחותיהם לבקש הלוואה תוך אמירת שקרים לגורמים המלווים. על תובע אחר הם כפו להקליט את עצמו אומר שהוא מרוצה מהשירות ומהיחס שהוא מקבל, "כל זאת בניגוד למציאות האובייקטיבית".
עורכי הדין מתייחסים לקשר של חברת סקסס ואלעד הדר לסיינטולוגיה, כפי שחשפנו במקום. הם מתארים בתביעה כיצד הלקוחות נדרשים לעבור מבחני אישיות הכוללים שאלות רפואיות ואינטימיות. לפחות לגבי תובע אחד נאמר כי הוא נדרש לבצע שינויים מהותיים בחייו, כולל כאלה הדורשים חוות דעת רפואית. לפי התובענה, אחד התובעים "עבר מכבש לחצים, כיתר הקורבנות על מנת לצרוך חומרי לימוד הקשורים לדת הסיינטולוגיה".
חומרי התביעה מציגים כיצד התנערה סקסס ממילוי תפקידה – מתן ייעוץ עסקי ללקוחותיה. לגבי אחד התובעים למשל, בעל בית דפוס, מתואר כי קיבל עצות שטחיות אשר "מעליבות אינטליגנציה אנושית בסיסית, כמו 'לך תחלק פלאיירים ברחוב'". עוד נכתב בכתב התביעה, כי "הפילוסופיה הקבועה (והבלתי נתפסת) של הדר היא: 'עדיף 1,000 לקוחות לא מרוצים, מאשר 100 לקוחות מרוצים', ובכך למעשה הוא חושף את השיטה: כמותי עדיף על איכותי, ובכך מבכר הוא את חשיבותו של גיוס הלקוחות האגרסיבי, החתמת הלקוח בכל מחיר – בין אם בעזרת שקרים בוטים, התנכלויות, איומים ובריונות משפטית – הכל כשר בדרך לכספו של הלקוח/ה".

כתב התביעה מתאר גם את השיטה שבה מגייס הדר לחברה יועצים עסקיים: המועמדים לתפקיד עוברים קורס על חשבונם תוך שהם מפקידים צ'ק על סך 30 אלף שקל במטרה למנוע מהם לעזוב את הקורס או להעביר מידע. לאחר הקורס, שכולל גם תכנים סינטולוגיים, עוברים המתמחים לעסוק בעבודות שעל פי כתב התביעה אין קשר בינן לבין ייעוץ עסקי או עזרה לעסקים במשבר.
כתב התביעה מעניק להדר 60 יום להגשת כתב הגנה, שיסתיימו בסוף החודש.
במקביל להגשת כתב התביעה מתבררות בבתי המשפט תביעות נוספות שבהן מעורבת סקסס. באחת מהן נתבעה ע', לקוחה לשעבר של הדר על סך 6,000 שקל כחלק מהשיטה שלו. לאחר שע' גוללה את מסכת ההתנהלות של החברה מולה, פסקה השופטת כי א.מ טייגר תשלם לע' את הסכום נשוא התביעה בתוך 60 יום. משטייגר לא שילמה לע', היא פתחה תיק בהוצאה לפועל נגד החברה וזכתה לקבל את כספה.
מחברת סקסס נמסר: "הרוח החיה מאחורי הגשת התביעה הינה תובעת שהוגש כנגדה תביעה בגין לשון הרע וכנקמה החליטה לקבץ מספר לקוחות עבר של החברה שחלקם היו כל כך מרוצים שקיבלו ייעוץ במשך מספר שנים. שמחנו לדעת שלאחר 20 שנות עשייה ומאות לקוחות שמקבלים שירות מדי חודש, נמצאו רק 11 לקוחות לא מרוצים. בידינו ראיות מוצקות להפריך את התביעה והכל ייאמר בבית המשפט. אנחנו מצטערים שהמקום הכי חם בגיהנום נרתם למאבק כספי של אנשים מסוימים".
