אחרי שעמותת עד כאן הגיעה לכותרות ב-2016 בעקבות הפעלת "שתולים" בארגונים המזוהים עם השמאל, תבעו את שוברים שתיקה והשתתפו בתחקיר על עזרא נאווי – בספטמבר האחרון שוב סערו הרוחות סביבה. בדיון שנערך בוועדת הכספים של הכנסת דרשה ח"כ נעמה לזימי מהעבודה לא לאשר לארגון הטבת מס לפי סעיף 46 (מתן הטבות מס לתורמים). "גוף שרודף פעילי שלום וזכויות אדם, במעשים פליליים ומפוקפקים, עם תורמים אנונימיים, לא צריך לקבל את כספי המדינה דרך הטבות מס", אמרה.
לזימי התייחסה בין היתר לקביעת בית המשפט השלום בירושלים בתביעה שהתבררה כנגד צד שלישי, שמסמכים שפרסם הארגון נגד פעילי שמאל היו מזויפים או נחשדים ככאלה; לפרסום שלפיו ארגון מגן – שבמסגרתו פעלה עמותת עד כאן – היה מעורב ביצירת מצג שווא על הטרדות מיניות מצד פלסטינים כלפי יהודיות; ולהאשמות בריגול כלפי שוברים שתיקה, שנדחו בבית המשפט העליון כחסרות בסיס.
יו"ר ועדת הכספים אלכס קושניר קיבל את הצעתה של לזימי, והוחלט שתיק העמותה יעבור לבדיקת רשות המסים. אלא שלאחרונה נודע כי בניגוד לעמדת לזימי והעבודה, קושניר יזם פנייה לרשות המסים בבקשה לקיים דיון חוזר בהטבות המס לעד כאן. המידע שאותו אנו חושפים כאן מאיר צד נוסף בהתנהלות העמותה, הנבדקת בימים אלה.
"חדירה לארגונים אנטי ישראליים"
עד כאן נוסדה בנובמבר 2015 על ידי גלעד אך ואבירם זאבי. מאז הקמתה, זאבי מכהן כיו"ר העמותה וכחבר וועד. זאבי היה עובד המשרד לביטחון פנים ולפי האתר הזה, מ-2017 הוא מנהל ביטחון בכלל ביטוח ופיננסים. אך הוא מנכ"ל עד כאן. בראיון לערוץ 7 סיפר על הקשר עם זאבי, ש"היה לא מעט שנים לוחם בשירותי הביטחון": "הכרנו במילואים כשאבירם שירת בפלוגה שפיקדתי עליה. לאחר צוק איתן הוא הצטרף לארגון".
עד כאן אינה העמותה הראשונה שבראשה עומד אך. ב-2011 הוא הקים את "הפורום לישראל ירוקה". במסמכים שמוציאה העמותה הוא מספר שהיא הוקמה על ידי "קבוצת צעירים בוגרי יחידות מיוחדות ומערכת הביטחון, אשר החליטו לפעול נוכח כמות ועוצמת המפגעים האקולוגיים אשר נחשפו אליהם". אחרי שנתיים הקים את עמותת "מגן לישראל יהודית ודמוקרטית", שתכליתה, כפי שאמר בראיון לערוץ 7: "חדירה לפעילות ארגונים אנטי-ישראליים וחשיפת דרכי פעולתם".
השנה הקים עם העיתונאי צבי יחזקאלי את העמותה "עוצרים את הג'יהאד העולמי", שמטרתה, בין היתר, "ניטור העברת כספי טרור שמיועדים לפגוע במדינת ישראל\העם היהודי. חשיפת מקורות המימון באמצעי תקשורת". באוגוסט נחשף בדה מרקר כי יחזקאלי הציג בחדשות 13 כתבה על תוכניות הבנייה של הרשות הפלסטינית בשטחי C, שמבוססת על מידע שהגיע מארגון "עד כאן", בלי לתת גילוי נאות על הקשר בינו לבין מנכ"ל הארגון.
זאבי ואך מחזיקים בבעלותם גם חברות פרטיות. זאבי את אפ-פוינמנט בע"מ שהוקמה ב-2014, ואך את חברת "חנית אסטרטגיה" שהוקמה ב-2015.
240 אלף שקל בשלוש שנים
ממידע שהגיע אלינו עולה שבין דצמבר 2014 ליוני 2017 קיבל אבירם זאבי, יו"ר הועד המנהל של עמותת עד כאן, דרך החברה הפרטית שבבעלותו, למעלה מ-240 אלף שקל מהעמותות "מגן – לישראל יהודית ודמוקרטית" ו"הפורום לישראל ירוקה", ומהחברה הפרטית בבעלות גלעד אך. מתוך סכום זה, יותר מ-180 אלף שקל התקבלו לכאורה בתקופה שלאחר הקמת עמותת עד כאן.
ממידע זה עולה חשד שזאבי קיבל כספים בתמורה לפעילות שקשורה לעמותה, דרך גופים שנמצאו בשליטת המנכ"ל אך – זאת לכאורה בניגוד לחוק שאוסר על מי שנותן שירותים לעמותה בשכר לכהן כחבר ועד (סעיף 33 א' לחוק העמותות).
הנחיות הרשם להתנהלות עמותות מסבירות ומפרטות ש"אסור לחבר ועד או לחבר ועדת ביקורת להיות עובד של העמותה או לתת לה שירותים שונים בשכר, לרבות כל התקשרות אחרת של חבר הוועד עם העמותה שכתוצאה ממנה תתקבל בידו תמורה".
ביולי השנה חשפנו כי רשם העמותות הורה על פירוק עמותת "משפחה חדשה". בבדיקה שערך הרשם עלה בין היתר שהעמותה מחלקת רווחים למייסדת, שמכהנת כמנכ"לית העמותה, באמצעות תשלומים לחברה שעל שמה ובבעלותה, באופן שמעלה חשש ל"חלוקת רווחים אסורה".
ב-2017-2016 ושוב ב-2019, עמותת עד כאן העבירה לרשם העמותות דיווחים חסרים בנוגע להעברת כספים בינה לבין "עמותות קשורות". כלומר, באותן שנים שבהן לכאורה הועברו כספים ליו"ר עד כאן, מגופים אחרים שגלעד אך מנהל, העמותה לא דיווחה לרשם באופן מלא על העברת כספים בינה לבין גופים קשורים אליה.

הדוחות הכספיים של עד כאן ל-2017-2016 ו-2019 כוללים התייחסות ל"עמותות קשורות" כחלק מדיווח הרכוש השוטף של העמותה. אולם, העמותה נמנעה מלפרט כנדרש מיהן העמותות הקשורות (דיווח כזה היה אמור להופיע בביאורים לדוחות הכספיים) ואף לא דיווחה על כל עסקאות עם גופים קשורים בדוחות המילוליים שהגישה באותם שנים. בנוסף, ככל הידוע לנו בהסתמך על תיק העמותה ברשם העמותות, לא הוגשו לרשם העמותות פרוטוקולים הנוגעים לאישור של עסקאות מסוג זה על ידי ועדת הביקורת של העמותה.
קטע מתוך דוח כספי של עמותת עד כאן לשנת 2019
הקשרים בין העמותות, בייחוד בין מגן לישראל לעד כאן, תוארו על ידי המנכ"ל אך כשדיבר עם מקור ראשון אחרי חשיפת השתולים: "כשהחלטנו בקיץ האחרון שאנחנו רוצים לצאת לתקשורת הקמנו את 'עד כאן', שהוא גוף שיותר בנוי לפרסום ופחות למחקר" והוסיף: "בסופו של דבר המטרה של הפיצול הזה היא להגן על העובדים של 'מגן לישראל'".
באותו ראיון טען שאין קשר בין הפורום לישראל ירוקה לשתי העמותות האחרות, אבל למרות ההפרדה לכאורה בין הגופים, יש ביניהם קשרים רבים. למשל, כתובת הדואר ומספר הטלפון המופיעים בדוחות של הפורום לישראל ירוקה (דוח מפברואר 2021, דוח מיוני 2020), זהים לאלה שמופיעים באתר האינטרנט של עד כאן. שני הארגונים מציגים את עצמם כמי שרשומים בת.ד. 4002 אריאל בטלפון: 02-5828188. אותו מספר טלפון מופיע גם בדיווח השנתי של עמותת מגן לרשם העמותות.
לפי הודאתו של אך עצמו, עד כאן פעל לפני שנרשם כעמותה באמצעות עמותת מגן לישראל. ב-2015-2014 הפורום לישראל ירוקה העסיק שלושה מה"שתולים" שהופעלו על ידי "עד כאן" בארגוני זכויות אדם (אז תחת הכובע של מגן לישראל): יצחק גולדווי, יוליה טרנטורוב, ואמיר בית אריה. למרות זאת, הפורום הכחיש מעורבות בפרויקט השתולים של עד כאן.
לפי הרישומים שלנו, ב-2016 וב-2017 היה גלעד אך מורשה חתימה בשלושת העמותות. בשנים שקדמו לכך היה מורשה חתימה הן ב"פורום" והן ב"מגן".
ברישומים אפשר לראות זהות בתפקידים שונים בשלושת העמותות. למשל, ב-2015 היה אורי גרובס המנהל האדמינסטרטיבי במגן, בפורום ובעד כאן. ב-2018 היה צחי דיקשטיין חבר וועדת הביקורת של מגן לישראל וגם הוצג בפרסומים שונים כסמנכ"ל של עד כאן.
לפי הרישומים שלנו, ב-2016 וב-2017 היה גלעד אך מורשה חתימה בשלושת העמותות. בשנים שקדמו לכך היה מורשה חתימה הן ב"פורום" והן ב"מגן"
רואה החשבון של הפורום ושל מגן כיום הוא יוסף מרדכי בן דרור, שחתום גם כרואה חשבון על הדוח השנתי של החברה של גלעד אך, חנית אסטרטגיה. ביולי 2017, הפורום לישראל ירוקה דיווח לרשם העמותות כי אך הפסיק לכהן כמנכ"ל הארגון, ובמקומו מונה אפרים מן.
למעשה, אם לשפוט על פי הפרסומים של העמותה עצמה, אך לא עזב את תפקידו בפורום לישראל ירוקה. הוא הוסיף להופיע כמנכ"ל העמותה למשל, בדוח שפרסמה ביוני 2020. פרוטוקול אסיפה כללית מ-2019 העלה כי מן מכהן כ"יועץ משפטי" של העמותה ואך מכהן כרכז פעילות. דוח שנתי של העמותה לשנת 2019 כולל דיווח על כך שאך שינה את מעמדו בעמותה והחל מאוקטובר 2020 הוא חבר ועד ומורשה חתימה. כחודשיים לאחר מכן הוא תואר בעמוד הפייסבוק של העמותה כמנכ"ל.
הלוואות הדדיות
ב-2015 מגן דיווחה לרשם העמותות על קבלת הלוואה בסך 94 אלף שקל מהפורום לישראל ירוקה, וכן על הלוואה של 5,000 מחברת חנית (בבעלות גלעד אך). ב-2017 הפורום לישראל ירוקה דיווח לרשם העמותות כי "העמותה [הפורום] הבהירה כי הקשר היחיד שקיים הינו בין העמותה לעמותת מגן לישראל יהודית ודמוקרטית, בכך שקיימת יתרת הלוואה שהעמידה עמותת מגן לעמותה בסך 49,647 שקל". כלומר, הפורום טען במענה לפניית רשם העמותות כי מגן העניקה לו הלוואה בעוד מגן דיווחה לרשם שהפורום העניק לה הלוואה.
הדוח הכספי של מגן לישראל ל-2018 כלל סכום גבוה יחסית של 261,181 שקל בשורה "חייבים ויתרות חובה" בפירוט הרכוש השוטף של העמותה.
באותו דוח, שהועלה לתיק העמותה במשרד המשפטים, מופיע דף טיוטה שבו מצוינים הסכומים הבאים: חנית 37,000; פורום 63,000; עד כאן 115,000; עובדים 45,000. בהמשך הטיוטה (לאחר רווח) מופיעים הסכומים 3,510 ו-5,429 תחת פירוט התחייבויות שוטפות, בשורות "הוצאות לשלם" ו-"ספקים ונותני שירות". הדוח לא כולל אזכור של הסכומים האחרים שצוינו בעמוד הטיוטה. .
את 2019 סיימה עמותת מגן לישראל בגרעון של כ-212 אלף שקל. ברשם העמותות לא מופיע הדוח הכספי של 2019 וכך אי אפשר לבדוק את מהות הגרעון. לארגון אין אישור על ניהול תקין ל-2021.
הדיווחים השנתיים של עד כאן רומזים על קשרי ניהול כספים נוספים בין העמותה לבין עמותות אחרות הקשורות אליה. בשנים 2017-2016 עמודת הרכוש השוטף בדוח הכספי של העמותה, כללה את שורת "עמותות קשורות", שתחתיה דווח על סכום של 33,772 שקל ב-2016 ו-171,452 שקל ב-2017. ב-2018 השתנה אופי הדיווח והשורה "עמותות קשורות" נעלמה, אולם באותה שנה דווח סכום של 379,122 תחת השורה "חייבים שונים" בפירוט הרכוש השוטף.
פנינו לאך וזאבי במספר שאלות לגבי הכספים שהועברו, הקשרים בין העמותות, הדוחות והאישורים החסרים. מעד כאן החליטו להתעלם מהשאלות הענייניות ומסרו בתגובה: "אנו מברכים את "המקום הכי חם בגיהנום" על הגילוי המדהים כי ארבעת התאגידים שייסד גלעד אך ומשמש בהם בעל תפקיד הינם "גופים קשורים" כפי שדיווחנו לרשויות בעצמנו בשקיפות מלאה במהלך כל השנים בדיווחים הפתוחים לציבור. נציין כי למרות הברכות עולה שאלה התזמון האם קיים קשר בין חשיפת "עד כאן" על הקשר בין רעם לחמאס לבין "התחקיר" שלכם?
"אכן כפי שציינתם בשונה מעמותות השמאל ומארגונים אנטי ישראלים המשופעים במימון ממשלות זרות במיליונים רבים מדי שנה, עמותות ציוניות נאלצות פעמים רבות להעזר בהלוואות בכדי להמשיך ולפעול כולל מאנשים פרטיים שמוכנים לרתום את הונם הפרטי למען המטרות הנעלות, אולם למרות הקושי התקציבי המתמיד אנו בטוחים שבזכות הפרסום באתרכם נזכה ללא מעט תומכים נוספים שייסעו בהמשך הפעילות החשובה. תודה רבה".
מרשות התאגידים נמסר: "הפנייה הועברה לבחינת הגורמים הרלבנטיים ברשם העמותות".
מרשות המסים נמסר: "לאור חובת סודיות הקבועה בדיני המס לא נוכל למסור פרטים בנושא".
